Acceptable Use Policy

This Acceptable Use Policy ("AUP") is an integral part of your agreement with ENGINYRING Europe SRL ("ENGINYRING") and is incorporated by reference into our Terms of Service. This AUP governs the use of all services provided by ENGINYRING (the "Services"). The User bears sole and exclusive responsibility for all activities conducted through the Services. Violation of this AUP constitutes a material breach of the Terms of Service and may result in immediate suspension or termination of your Services without refund.

1. Purpose

The objectives of this AUP are to:

• Ensure the security, stability, and reliability of our network and services for all users.
• Promote the responsible use of internet resources and discourage activities that degrade the usability and value of the internet.
• Protect the rights, privacy, and security of individuals and organizations.
• Comply with all applicable laws and regulations.

2. General Rules of Conduct

2.1 The User bears sole responsibility for ensuring their use of the Services is lawful and does not interfere with or disrupt other users, networks, or services on the internet.

2.2 The User must comply with all reasonably formulated instructions from ENGINYRING regarding the use of the Services.

2.3 The User is strictly prohibited from transmitting, hosting, or posting any material that is illegal, unlawful, threatening, abusive, discriminatory, defamatory, or encourages conduct that could be considered a criminal offense, give rise to civil liability, or otherwise violate any Romanian or international laws.

2.4 The User is strictly liable for preventing the distribution of computer viruses, malware, or other malicious programs through their use of the Services.

2.5 The User must ensure that any systems connected to our network are configured with adequate security measures. ENGINYRING may assess the adequacy of those measures acting reasonably and based on the technical and security risks presented.

2.6 The User is responsible for maintaining the confidentiality of all account credentials (including passwords) and must inform ENGINYRING immediately of any suspected or actual unauthorized access to their account or services.

3. Prohibited Activities

The following activities are strictly prohibited. Engaging in any of these activities, directly or indirectly, will be considered a material breach of this AUP:

• Unauthorized Access: Accessing or attempting to access any system, account, or data without authorization (e.g., hacking, port scanning).
• Denial of Service (DoS): Launching or participating in any DoS or Distributed Denial of Service (DDoS) attacks against any target.
• Interference: Intercepting, monitoring, or manipulating network traffic not intended for the User.
• Spam & Unsolicited Communication: Sending unsolicited bulk email (spam), mail bombing, or any other form of abusive electronic communication.
• Forgery & Impersonation: Falsifying or manipulating electronic message headers, IP addresses, or any other identifier to impersonate another person or entity.
• Malware Distribution: Hosting, distributing, or linking to any form of malware, viruses, trojans, phishing sites, or other malicious code.
• Illegal & Harmful Content: Hosting, distributing, or transmitting content related to:
  • Child sexual abuse material (CSAM) or any form of child exploitation.
  • Content that promotes terrorism, incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or any other protected characteristic.
  • Content that facilitates illegal activities (e.g., illegal drug trade, illegal gambling).
  • Unauthorized distribution of copyrighted or trademarked material (piracy).
  • Content that infringes on the privacy, personal data, or other rights of individuals.
• Resource Abuse: Using the Services in a manner that consumes excessive resources (CPU, memory, I/O, network) to the detriment of other users. This includes, but is not limited to, cryptocurrency mining.
• Circumvention of Security: Attempting to bypass or disable any security, filtering, or authentication measures of our Services or network.
• Geographic Restrictions & Access Control Evasion: Using our Services to circumvent geographic restrictions, access controls, or blocklists imposed by third-party services or governments. This includes, but is not limited to, using our IP addresses as proxies for streaming services (Netflix, Hulu, Disney+, Amazon Prime, etc.), evading country-level censorship or sanctions, or any activity that could result in our IP addresses being blacklisted, flagged, or rendered unusable for legitimate users.
• Catch-All Provision: Engaging in any other activity that ENGINYRING reasonably determines, based on available technical, legal, security and abuse information, to be harmful, abusive, or threatening to its network, services, reputation, or other users.

4. Specific Service Restrictions

4.1 Email and SMTP: By default, SMTP traffic, including ports 25, 465 and 587, is blocked on virtual and dedicated server plans. The restriction may be lifted only after successful KYC validation and payment of any applicable fee disclosed before approval. Bulk or mass mailing requires separate prior written approval. Lifting a technical block does not authorise unsolicited messaging. Any unauthorised bulk mailing, spam complaint pattern or material mail-reputation incident may result in immediate and permanent reinstatement of the block, suspension or termination without refund. Outbound email use through a standalone IPv4 leasing service is prohibited unless separately approved in writing.

4.2 Network Usage: Our services may not be used for operating open proxies, TOR relays/exits, or any service intended to anonymize or obscure network traffic without our explicit prior written consent.

4.3 File Hosting: The Services may not be used for the primary purpose of mass file hosting, archival, or as a public-facing Content Delivery Network (CDN) without a specific agreement to that effect.

4.4 ENGINYRING may determine, acting reasonably and based on available technical, legal, security and abuse information, what constitutes excessive or abusive resource consumption.

4.5 IPv4 Address Resources: A User assigned or leasing an IPv4 prefix shall comply with the IPv4 leasing provisions of the Terms of Service and all routing, registry and abuse instructions issued by ENGINYRING. The following are prohibited unless expressly approved in writing:

• Announcing a prefix through an ASN other than the Authorised ASN, announcing an unauthorised more-specific route, creating an unauthorised multiple-origin condition, route leak, forged AS path, forged LOA or conflicting ROA, IRR or registry object.
• Announcing, using or permitting use of a prefix before activation or after expiry, suspension, withdrawal or termination of authority.
• Reselling, subleasing, reassigning, reallocating, subdelegating or allowing a third party or affiliate to originate or use the prefix without ENGINYRING's prior written approval.
• Source-address spoofing or operating a network without reasonable ingress and egress filtering designed to prevent spoofed traffic.
• Snowshoe spam, distributing messaging across addresses to evade reputation controls, unsolicited communications, unauthorised mass mailing or any conduct intended to evade blocklists, rate limits, fraud controls or abuse detection.
• Bulletproof hosting; phishing; malware, botnet or command-and-control infrastructure; credential theft or stuffing; fraudulent account creation; DDoS-for-hire; traffic laundering; or knowingly enabling comparable abuse.
• Operating public proxies, VPN exit services, Tor exits, traffic-obfuscation services, residential-proxy networks or similar services without specific prior written approval.
• Manipulating or misrepresenting geolocation, network ownership, registry, reputation or routing information to deceive third-party security, sanctions, fraud-prevention or access-control systems.
• Providing inaccurate, obsolete or unmonitored technical, NOC or abuse contacts, or failing to notify ENGINYRING of loss of ASN control, unauthorised routing or compromised credentials.
• Failing to investigate, mitigate or substantively respond to an abuse or routing-security instruction within the deadline specified by ENGINYRING.
• Any activity reasonably likely to cause material blocklisting, route rejection, registry sanctions, resource reclamation or technical or commercial impairment of the IPv4 Resource.

4.6 Downstream Responsibility: Where downstream use has been expressly approved, the User remains fully responsible for every downstream customer and end user, shall maintain accurate allocation and identity records, shall bind them to equivalent acceptable-use restrictions and shall provide relevant records promptly when required for abuse investigation, registry compliance or a lawful request.

5. Monitoring and Enforcement

5.1 ENGINYRING has no obligation to monitor user activity, but reserves the right to investigate any reported or suspected violation.

5.2 ENGINYRING may determine, acting reasonably and based on available technical, legal, security, routing and abuse information, whether conduct violates this AUP. We are not required to provide an opportunity to cure before taking protective action where delay could create legal, security, routing, abuse or reputational risk.

5.3 In response to a violation, we may take any action we deem appropriate, including but not limited to:

• Issuing a formal warning.
• Suspending access to the Services.
• Terminating the Services immediately and without prior notice.
• Removing or blocking access to the offending content.
• Charging the user for costs incurred in investigating and remediating the violation.
• Reporting the illegal activity to the appropriate law enforcement authorities.
• For IPv4 resources, withdrawing or revoking LOAs, ROAs, IRR or registry objects, reverse DNS or routing authorisation; requesting upstream filtering or null-routing; and notifying RIRs, routing-security operators or the Resource Holder.

5.4 Where a leased IPv4 Resource is involved, ENGINYRING may act immediately to contain abuse or unauthorised routing. The User shall cooperate with route withdrawal, evidence preservation, customer identification and remediation and shall not obstruct or recreate any withdrawn authorisation.

6. Security Requirements

6.1 The User is strictly and solely liable for maintaining the security of their systems, accounts, and content. This includes:

• Using strong, unique passwords and enabling two-factor authentication where available.
• Keeping all software, applications, and scripts updated with the latest security patches.
• Implementing appropriate firewalls and access controls.
• Regularly backing up all critical data.

6.2 If we detect a security vulnerability on a user's service, we reserve the right to take immediate protective action, including temporary suspension, to protect our network and other users.

7. Reporting Abuse

7.1 To report a violation of this AUP or any illegal content hosted on our network, please contact our abuse team immediately via:

7.2 Please provide detailed information to facilitate our investigation, including the nature of the abuse, timestamps, and the IP address or domain involved.

7.3 Users controlling leased IPv4 Resources must maintain a monitored abuse mailbox and operational contact. Critical reports, including active phishing, malware command-and-control, CSAM, ongoing DDoS, source-address spoofing, route hijacking or route leakage, must be acknowledged within four hours and mitigated immediately or within the deadline specified by ENGINYRING. Other substantiated reports must be acknowledged within 24 hours.

7.4 An automated acknowledgement is not a substantive response. The User must investigate, preserve relevant logs, identify the affected system or downstream user, take effective corrective action and provide evidence or a remediation summary when requested.

8. Modifications to this Policy

8.1 ENGINYRING reserves the right to revise this AUP at any time. We will provide notice of material changes via email or a notice on our website. Continued use of our services after such notification constitutes acceptance of the updated policy.

9. Consequences of Violation

9.1 A violation of this AUP is considered a material breach of our Terms of Service and may result in the immediate suspension or termination of your services without refund or credit.

9.2 You shall be held liable for and agree to fully indemnify ENGINYRING for any and all costs, damages, fines, or legal fees incurred by ENGINYRING as a direct or indirect result of your violation of this AUP.

9.3 For IPv4 Resources, recoverable amounts may include reasonable and documented registry correction, route-withdrawal, upstream, incident-response, blacklist or reputation remediation, post-lease quarantine, investigation and enforcement costs, together with ordinary lease charges for any period of unauthorised continued use.
